Terms and Conditions

1. What the Platform is

SwapBooks is a listing and coordination tool that lets users register physical books, publish listings to swap, sell, or lend them, and communicate with other users about those listings. The Platform does not buy, sell, own, inspect, authenticate, insure, store, ship, or take possession of any book at any point. White Pigeon Solution is not a party to, and has no involvement in, any swap, sale, loan, gift, or other transaction or exchange ("Transaction") that users arrange through the Platform. Every Transaction is a private arrangement solely between the users involved.

2. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

3. User conduct and content

You are solely responsible for every listing, photo, comment, message, feature request, and any other content you submit to the Platform ("User Content"), and for every Transaction you enter into using it. You agree not to:

• List a book you do not lawfully own or have the right to swap, sell, lend, or gift;
• Misrepresent a book's condition, authenticity, edition, or any other material fact;
• Use the Platform for any unlawful, fraudulent, harassing, defamatory, or abusive purpose;
• Attempt to circumvent, disable, or interfere with the Platform's security, rate-limiting, or anti-abuse measures; or
• Upload content that infringes another person's intellectual property, privacy, or other rights.

We may remove User Content, suspend, or terminate any account, at our discretion, without notice, for any conduct we believe violates these Terms or is otherwise harmful to the Platform or its users.

4. In-person exchanges and Transactions — assumption of risk

Completing a swap, sale, loan, or gift arranged on the Platform typically requires users to meet in person, exchange payment outside the Platform, or ship an item to one another. You acknowledge and agree that:

• White Pigeon Solution does not verify the identity, trustworthiness, location, or intentions of any user;
• White Pigeon Solution does not verify a listed book's condition, authenticity, or the accuracy of any listing or ownership history shown on the Platform;
• any decision to meet another user, exchange a book, make or accept payment, or ship an item is made entirely at your own discretion and risk; and
• you are solely responsible for taking reasonable precautions, including meeting in safe public locations and independently verifying anything material to your decision to proceed.

White Pigeon Solution is not responsible for, and bears no liability for, any loss, theft, damage, injury, non-delivery, misrepresentation, payment dispute, or other harm arising from or in connection with any Transaction or in-person meeting arranged through the Platform.

5. No warranty

THE PLATFORM, AND ALL CONTENT AND FUNCTIONALITY ON IT, ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE. White Pigeon Solution MAKES NO WARRANTY ABOUT THE QUALITY, SAFETY, LEGALITY, OR ACCURACY OF ANY LISTING, USER, OR USER CONTENT.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, White Pigeon Solution, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR A BOOK ITSELF, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR USE OF THE PLATFORM, ANY TRANSACTION, ANY USER CONTENT, OR ANY CONDUCT OF ANY OTHER USER — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND EVEN IF White Pigeon Solution HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY EXCLUDED UNDER APPLICABLE LAW, White Pigeon Solution'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO White Pigeon Solution (NOT TO ANY OTHER USER) IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ₹500.

7. Indemnification

You agree to indemnify, defend, and hold harmless White Pigeon Solution and its owners, directors, officers, employees, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to: your use of the Platform; any Transaction or in-person exchange you enter into; your User Content; your violation of these Terms; or your violation of any right of a third party.

8. Third-party services

The Platform relies on third-party services to function, including Google (sign-in and book data), a transactional email provider, an SMS/WhatsApp provider for one-time codes and notifications, and cloud file storage for photos. These services are governed by their own terms and privacy policies, and White Pigeon Solution is not responsible for their availability, accuracy, or conduct.

9. Intellectual property

The Platform's design, branding, and underlying software are the property of White Pigeon Solution or its licensors. By submitting User Content, you grant White Pigeon Solution a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display it solely for the purpose of operating and improving the Platform. You retain ownership of your User Content.

10. Termination

You may stop using the Platform, and delete your account, at any time from Settings. We may suspend or terminate your access to the Platform at any time, with or without cause or notice. Sections of these Terms that by their nature should survive termination (including Sections 4 through 7) will survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in India.
